1. Acceptance of Terms

By accessing or using the KitBee application and website at kitbee.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. "KitBee," "we," "us," and "our" refer to the KitBee organization operating the Service.

2. Beta Service

KitBee is currently in beta. The Service is provided on an "as-is" and "as-available" basis. Features may change, be removed, or experience interruptions without prior notice.

While we make reasonable efforts to protect your data, we do not guarantee that data will be preserved during the beta period. We recommend keeping copies of important recipes and information outside of the Service.

3. Account Responsibilities

You are responsible for:

• Providing accurate information when creating your account
• Maintaining the security of your login credentials
• All activity that occurs under your account
• Notifying us promptly of any unauthorized access

You must be at least 13 years old to create an account and use the Service.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or its infrastructure
• Upload malicious code, spam, or harmful content
• Scrape, crawl, or use automated tools to extract data from the Service
• Impersonate another person or misrepresent your affiliation
• Use the Service to infringe on the intellectual property rights of others

5. Intellectual Property

5.1 Your Content

You retain ownership of the recipes, meal plans, and other content you create or import into KitBee ("Your Content"). By using the Service, you grant us a limited, non-exclusive license to store, process, and display Your Content solely for the purpose of providing the Service to you.

5.2 Our Platform

The KitBee name, logo, design, code, and all other materials that make up the Service (excluding Your Content) are owned by KitBee and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our prior written consent.

6. AI-Generated Content

KitBee uses artificial intelligence (powered by the Anthropic Claude API) to parse, structure, and suggest recipe content. AI-generated output may contain errors, inaccuracies, or omissions.

You are solely responsible for reviewing and verifying any AI-generated content before relying on it. This includes checking ingredient quantities, cooking temperatures, and allergy information. KitBee does not guarantee the accuracy, safety, or suitability of AI-generated content. Always use your own judgment when preparing food.

7. Third-Party Integrations

The Service may integrate with third-party services such as Google Calendar. Your use of these integrations is subject to the third party's own terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

8. Limitation of Liability

To the maximum extent permitted by applicable law, KitBee and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service.

This includes, but is not limited to, damages for loss of data, loss of profits, or damages arising from reliance on AI-generated content (including dietary suggestions, ingredient information, or cooking instructions). Our total liability for any claim related to the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is greater.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

10. Termination

You may stop using the Service and request account deletion at any time by contacting us at support@kitbee.ai.

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. We may delete your account data after termination in accordance with our Privacy Policy.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in a court of competent jurisdiction within the United States.

12. Changes to These Terms

We may revise these Terms at any time by posting the updated version on this page and updating the "Last updated" date. Material changes will be communicated through the Service or via email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
